Welcome to Capitalk. These Terms of Service and Agency Framework govern the relationship between Capitalk Sdn. Bhd. and our clients, including both End-users and official Agencies. By utilizing our platform and engaging our services, you agree to be fully bound by the terms outlined below.

1. Scope of Services

Capitalk provides end-to-end strategic advisory solutions for VISA pathways, professional education planning, and seamless cross-border business expansion. Our core services include Personal Identity Advisory, Talent & Investors, Corporate Training & Audits, and Overseas Business Setup. We design cross-border pathways and business structures that help corporate entities, students, and ambitious professionals transition and scale globally with complete peace of mind.

2. User Categories & Agency Framework

2.1 Client Classification
Our services are provided to two main categories of users: End-users (direct clients) and Agencies (authorized partners).
2.2 Agency Approval
Any entity or individual wishing to act as an Agency must successfully pass an internal review conducted by Capitalk.
2.3 Pricing and Commission System
For approved Agencies, Capitalk provides a fair and standardized base price for our services. Agencies are authorized to use our internal system to incorporate and set their own commission structures on top of this base price. The system will then generate a final unified invoice for the End-user to complete the direct payment.

3. Currency and Compliance

To ensure standardized operations and financial compliance, all transactions, service base prices, agency commissions, and final payments must be conducted exclusively in Malaysian Ringgit (RM).

4. Strict No Refund Policy

4.1 General Rule
Once our advisory or execution services have been initiated or pushed forward within our system, strictly NO REFUNDS will be issued under any circumstances.
4.2 Negligence Clause
If a service fails, is delayed, or cannot proceed due to any negligence on the part of the End-user or the Agency (such as failure to provide required documents, submitting incorrect information, or concealing facts), no refunds will be provided, and no transfer of funds or services will be permitted.

5. Service & Fund Transfer Mechanism

As an alternative to direct refunds, Capitalk provides a conditional transfer mechanism:

5.1 Transfer Eligibility
A transfer request may only be raised if there is a documented error in the paperwork or processing, AND it is definitively proven that the error was NOT caused by the End-user or the Agency.
5.2 Transfer Execution
If the conditions above are met, while monetary refunds remain unavailable, the affected service and its equivalent monetary value can be transferred and applied to another designated End-user. All transfer requests must be submitted through our system and are subject to final assessment and approval by Capitalk.

6. Governing Law

All business transactions, agency operations, and services facilitated by Capitalk are legally compliant and fully governed by the laws of Malaysia. Any disputes arising from these terms shall be resolved under Malaysian jurisdiction.
