Refund & Transfer Policy

This policy governs the refund, cancellation, and dispute resolution processes for all services provided by Capitalk Sdn. Bhd., including Personal Identity Advisory, Education Planning, and Overseas Business Setup. By engaging our services, whether as an End-user or an official Agency, you fully agree to the terms outlined below.

1. Strict No Refund Policy

1.1 General Rule
All advisory, execution, and consultation services provided by Capitalk are highly customized. Strictly NO REFUNDS will be granted under any circumstances once a service has been officially initiated, pushed forward in our system, or payment has been processed.
1.2 Acknowledgment
Clients and Agencies must ensure they fully understand the nature of our cross-border pathways and structures before making any payment. Processing a payment constitutes full acceptance of this non-refundable term.

2. Client & Agency Negligence Exemption

Under our absolute no-refund framework:

2.1 Liability
If the progress of a service is hindered, delayed, or rejected due to the negligence of the End-user or the Agency, Capitalk shall hold no liability.
2.2 Definition of Negligence
Such negligence includes, but is not limited to, failure to provide necessary documents within stipulated timelines, submission of false or invalid materials, concealment of critical background facts, or non-compliance with local regulations.
2.3 Consequences
If a service fails due to the aforementioned negligence, no refunds will be issued, and the transfer of funds or services to another user will be strictly prohibited.

3. Conditional Service & Fund Transfer Mechanism

As traditional "returns" are inapplicable to consulting and structural setup services, we offer a conditional transfer mechanism:

3.1 Transfer Eligibility
Clients or Agencies may only request a transfer if an explicit error occurs in the documentation or application procedure, AND it is officially verified through our investigation that the error was absolutely NOT caused by the End-user or the Agency.
3.2 Execution of Transfer
If the criteria in Clause 3.1 are met, direct financial refunds remain unavailable. However, the End-user or Agency retains the right to request that the affected service and its equivalent monetary value be wholly transferred and applied to another designated End-user.
3.3 Approval Process
All transfer requests must be formally submitted in writing to our internal system and are subject to final evaluation and approval by Capitalk management.

4. Currency & Legal Jurisdiction

4.1 Standardized Currency
All transactional values, agency commissions, and transfer equivalents are exclusively calculated and settled in Malaysian Ringgit (RM).
4.2 Governing Law
All transactions and operations are legally compliant and strictly protected by the laws of Malaysia. Any unresolvable disputes shall be subject to the exclusive jurisdiction of the competent courts in Kuala Lumpur, Malaysia.
